As an employer, you need advice on a variety of legal issues. Naturally, we have expertise in additional areas of employment law. These include:
Immigration
For the employer that employs several foreign nationals in a variety of departments, divisions, or units, immigration training may be a critical (and overlooked) component of your training program. In particular, Managers, In-House Recruiters, and Human Resources staff may need a single set of guidelines and expectations when it comes to hiring foreign nationals. When will your company sponsor a potential employee for a Temporary employment visa? Under what circumstances does your company pursue Permanent Residence for an employee? What is the difference between a Temporary Employment Visa and Permanent Residence? If your Managers, In-House Recruiters, and Human Resources staff are unclear about the answers to these questions, we can help.
Investigations
Employers can train employees and managers to prevent and avoid harassment and discrimination. But training does not eliminate the potential for a claim filed by an employee. In some cases, employers need outside counsel to conduct an investigation to determine if a complaint has merit. To avoid the prospect of having a biased investigation, outside counsel may be required. If, however, you expect the investigator to provide testimony during future litigation, you may need counsel separate from the firm you regularly retain. We can work closely with each client to conduct a prompt and thorough investigation, and work closely with your current counsel to ensure the maximum confidentiality.
Litigation
Ultimately, not every dispute can be resolved amicably. In some cases, litigation results. Litigation may be initiated by an employee under a variety of statutes and common law. Or an employer may need to pursue litigation to protect its rights and its business. In either case, we stand ready to assist clients in this critical time.
